Flute Service

Got my flute back from the service centre today, almost like brand new now. Almost because I still see rusty stains between those hard to get places… arrgh, they’re so irritating to look at!

I drove all the way to Penampang New Township, to find this service centre… never expected to see a Musical Instrument service centre to look so much like a car service centre!

As a matter of fact, the shop is located in the midst of a few car workshop… when I asked how to find the shop, I was actually told it was right beside 2020 car service centre!

It happened while we were in the High Court waiting for the interpreter to call out the winding-up cases.

We saw the interpreter stood up and … he said,

“Company Swine-ding up No …”

Me and another learned friend burst out laughing in court!
With our mouths covered of course… what a scene it would be if we had laughed out loud!

These days, with the threatening flu plague, people are really sensitive of the word “swine”… so anything sounds “swiney”…

So Companies Winding Up can become
Company Swine Ding Up!

Next time, when you need to say the word, make sure you say it out slowly ah… wetsifut

It’s unusual for LD to simple ignore Bobo (the doggie plush toy) on his head and just let me take pictures of him… normally he would be jumping right at me… barks at me… tore my shorts dragging me to bring him out for a walk (a long one)… it’s a bit disheartening to see him just lying down lazily like that… like his spirit has left him… but I’m neutering him is what I must do… as I look forward to a healthy and long lived LD… with many many years ahead… lots and lots of joy together!

I won’t mind you being such a menace, I promise!

dateline and deadline

Talk about stubbornness…

I’ve told the staff so many times that dateline is not deadline and there is only deadline to meet not dateline.

“But… all the partners in the firm is using dateline…”

“We changed it to deadline, the letter will be returned to us for amendment to dateline…”

Sigh… what’s the dictionary for then? If someone is wrong, you just follow blindly?

Consent Judgment and Judgment by Admission

One judge is very particular about terminology,
and all the lawyers learned from her court that a Judgment by Admission is not a Consent Judgment.

Some fresh lawyers may have been confused into thinking that in her court, one can ONLY say “Judgment by Admission” as their seniors must have warned them about this “particular judge”.

This morning, we have a Consent Judgment but the Plaintiff’s lawyer called it a Judgment by Admission… and I thought, “uh oh!”.

The judge went, “A judgment by Admission of Claim?”
I quickly stood up and said, “Your honor, it’s a Consent Judgment”.

Then later, another lawyer stood up for her case, hers is really a Judgment by Admission, but she must have thought since just now the other lawyer was corrected to “Consent Judgment”, she quickly corrects herself saying it’s a Consent Judgment!

Actually, there’s a difference between the two.

Judgment by Admission is when the Defendant is present in the court at the first mention and admits to the claim as stated in your Statement of Claim and is not defending the matter. As such, Defendant has to pay the entire amount as claimed.

Consent Judgment is when both parties agreed to a settlement sum, which is most probably a lesser amount compared to what the Plaintiff has initially claimed in the Statement of Claim. Thus a “judgment by consent” will be entered against the Defendant for the payment of the amount in accordance with the consented amount.

Practising Lawyer

“What are you doing now?”
“I am a practising lawyer…”
“How long do you have to practice to be lawyer?”

“Err…”

It never occured to me that it will be confusing to tell people I am a “practising lawyer”… until I was asked how long do I need to “practice” to be a lawyer till I can be a real lawyer! :s

Actually, practising lawyer means a lawyer who is in practice (just like a doctor being called a practitioner), ie, a working lawyer who has a practice certificate, a licensed lawyer so to speak! A lawyer who is no longer under pupilage*, and has been called to the bar** and has a current Practice Certificate***.

*Pupilage is the 9 months (in West Malaysia) or 12 months (in Sabah/Sarawak) training period (not practising but training) every lawyer has to undergo before they could be “Call to the Bar”".

**Call to the Bar means being called to the legal fraternity. In practice, it means a lawyer whose name is on the Rolls of the High Court. Ie, the name is listed as a lawyer in the High Court’s list of lawyers!

***Lawyers have to pay a prescribed fee to the courts for their names to be kept in the Rolls. Therefore, each year, lawyers have to renew their respective practice certificate in order for their names to be retained in that Roll so that they could continue to “practise” as a lawyer! :)

Meniere Disease

Am I having Meniere Disease? Well, I don’t know, because even the doctor that examined my ears couldn’t tell.

I don’t feel dizzy, no pain…
Just having this echoic sound in my ears when I talk on the phone as if I am under water. I also hearing a lesser sound volume from my left ear compared to my right ear. I called it, “diving sensation”.

Happened to me years ago when I was still working in KL with MLJ, and I remembered the doctor I went to see whose clinic was on the KUB building, Dr Ngu! :p

Just as the doctor I saw in KK, Dr Ngu in KL told me my ears looks normal and clean, no redness or swollen or blockage… and nothing to indicate I had an ear infection.

Well, as long as I won’t lose my hearing, I am glad.

The “diving sensation” went away very fast after I saw the doctor in KL. I was hoping this time it would go away very soon too.

Doctor in KK gave me some tablets called papase and told me go see an ear specialist if the symptoms won’t go away after I finished the medication. Gosh! See a specialist? Is that really necessary?

As I was reading about the treatment for Meneire Disease from wikipedia, I was found guilty of having high sodium diet, and being an excessive caffeine drinker!  Mmm… maybe I should cut down on Maggie Seasoning and Nescafe… (you see, I am self-treating again… that’s why I always say I don’t need to see doctors!)

Zoshigaya Missionary Museum

Was flipping through the Insight City Guide Tokyo when  I came across this missionary museum in Japan, and of all places of Japan, Tokyo!

This American colonial-style house was built in 1907 by an American missionary, John Moody McCaleb, who spent 50 years in Japan.

When I first learned of the name, I though he was THE famous Moody, but I was wrong, that was Dwight Lyman Moody.

Reading their stories… I am truly touched!

The Fish that Swallowed Jonah

Mom was telling me this riddle that was addressed to her and her classmates at the Sabah Bible Seminary class:

What’s the name of the fish that swallowed Jonah?

So I tried, Whale? Nope.
Err… Big Fish? Nope.

Before I could think further, mom exclaimed, “Selfish lar!”
Hahahah… got me on that one!

Yes, indeed, Jonah was swallowed by his own selfishness…

If you wonder what’s the story about Jonah, here’s from the Bible for Children by V. Gilbret Beers:

“Go to Nineveh,” God told Jonah. “Tell the people there I will destroy them because they are so wicked.” Jonah didn’t want to go to that wicked city. He didn’t want to do what God said. So he ran away. He got on a ship headed in the other direction.

But God knew where Jonah was. Jonah couldn’t hide from God.

God sent a terrible storm. The Ship on which Jonah was sailing was about to sink. The sailors were afraid they would all go down with the ship. So they began to throw things overboard. While that was happening, Jonah was sleeping down below.

When the captain found Jonah, he shouted at him, “How can you sleep through all this? Get up and pray.”

The sailors thought the storm had come because God was angry with someone on the ship. So they drew lots to see who had done something wrong. That’s how they found out it was Jonah.

So God ordered the great fish to spit Jonah out on land. The fish obeyed, and Jonah was safe. He would not run away from God anymore.
