We requested from the Vendor's solicitors, a Letter of Undertaking to refund loan sum in the event the transfer of title cannot be registered as stipulated in the Sale and Purchase Agreement. The brilliant lawyer replied saying that the LU is not required now because the "contingency" of "the title cannot be registered" has not happened, and so the Vendor doesn't need to provide the LU now.
... I lie, I brag, I boast naturally... so please don't get serious about whatever I say or write :)
